Terms and Conditions
1.
Contract
After you
have completed the booking form and forwarded the deposit, we shall forward a
booking confirmation invoice. A
contract, on the basis of the information described in the itinerary will
accordingly be constituted between you, the client, and Learmont Mackenzie Travel (also we
and us). The contractual agreement is subject to Scots
Law and the exclusive jurisdiction of the Scottish Courts. Acceptance of these booking conditions is
implied when a booking is made.
2.
Deposit and Balance of Payment
In order to
confirm your booking, Learmont Mackenzie Travel require you to pay a deposit of £50 per
person. The deposit is non refundable
unless your chosen weekend (the weekend) is fully booked, or no longer
available. On receiving the deposit, we
will send you receipt of payment, confirmation of your booking and an invoice
for the outstanding balance. The balance
must be paid eight weeks before the weekend.
Unless we receive the balance timeously, we
reserve the right to cancel your booking.
If you make a booking eight weeks prior to the weekend, we require you
to make payment in full.
3.
Our prices
The prices
quoted in the booking form are correct as at November 2006. We reserve the right to change them at any
time before we enter into a contract with you.
4.
Cancellation by you
If you
cancel the weekend, you must notify us in writing. If the cancellation is made at any point in
the eight weeks prior to the weekend, we require you to pay cancellation costs,
as follows, based on a percentage of the total cost of the weekend:
56-43 Days prior to
the weekend: 20%
42-29 Days prior to
the weekend: 40%
28-15 Days prior to
the weekend: 60%
14-8 Days prior to the
weekend: 80%
7 days prior to the
weekend: 100%.
We strongly
suggest that you take out adequate travel insurance. Cancellation costs will be refunded to you by
your insurance company if the circumstances of cancellation fall within the
terms of your insurance policy. We may
not insist on our right to claim cancellation costs if, at short notice, we are
able to find another client to take your place.
5.
Cancellation by us
We reserve
the right to cancel a weekend in any circumstances up to eight weeks prior to
its commencement. In the event of a cancellation, we shall offer you the choice
of a full refund of any payments made or an alternative weekend, should that be
available. We shall not make a cancellation within eight weeks of the weekend
except in the event of unforeseen circumstances beyond our control amounting to
force majeure. Examples of force majeure include terrorist activity,
industrial disputes, natural or nuclear disaster, strikes, fire, flooding or
adverse weather conditions. In the event
of cancellation necessitated by force majeure we shall not pay you compensation.
6.
Alterations
If you wish
to alter the weekend, you must notify us in writing. We undertake to do our best to accommodate your particular request subject to
the availability of alternative weekends.
An amendment fee of £ 20 per person will be charged in respect of any
alteration made. The amendment fee
covers necessary administrative costs.
7.
Medical Conditions
You are
required to let us know if you suffer from any significant medical conditions
including vertigo, asthma and diabetes.
8.
Accommodation
The nature of your accommodation is described in each individual
itinerary. We undertake to allocate
accommodation according to availability on the understanding that you are aware
that individual rooms may vary according to the size, age and structure of
individual premises, houses and hotels.
9. Liability
We cannot accept liability for any loss, damage or injury resulting from any circumstances beyond our control. As tour operators we have public liability insurance, but no personal insurance is included in the tour prices. We strongly recommend you take out a comprehensive travel insurance policy with cover for accident or illness; medical emergency; repatriation costs; loss of luggage, money or personal possessions; personal liability; cancellation or delay of travel arrangements; and cancellation or curtailment of your weekend.
10.
Complaints
If you have a complaint during the course of the weekend you should bring it to our attention immediately so that we can rectify matters on the spot. If the matter cannot be resolved during the course of the weekend you should write to Learmont Mackenzie within 14 days of the end of the weekend.
